General Terms and Conditions for Latin Festival

1. Scope

These General Terms and Conditions (hereinafter “Terms”) apply to all contracts for the purchase of admission tickets (hereinafter “Tickets”) for the event Latin Festival, organised and held by Kiarash Sanei Kashany, Mercedesstraße 7, 70372 Stuttgart, Germany (telephone: +49 174 233 2742, e-mail: info@salsa-company.de) (hereinafter the “Organiser”).

By purchasing a Ticket, the buyer (hereinafter the “Customer”) accepts these Terms as binding.

2. Formation of contract

(1) The contract for the purchase of a Ticket is concluded exclusively between the Customer and the Organiser.

(2) By completing the order process (for example by clicking “Buy”), the Customer makes a binding offer to enter into a contract of sale. The contract comes into effect upon confirmation by the Organiser (for example by e-mail with the Ticket attached, or a booking confirmation).

(3) The resale or commercial use of Tickets without the prior written consent of the Organiser is prohibited.

3. Personalised tickets and name changes

(1) All Tickets are personalised and are valid solely for the person named on the Ticket.

(2) A name change may be requested in writing to info@salsa-company.de. A processing fee of €25.00 per Ticket applies.

(3) The Organiser reserves the right to refuse a name change, in particular where there is reason to suspect improper resale or abusive use.

4. Returns, exchange and right of withdrawal

(1) Returning or exchanging Tickets is excluded once the purchase has been completed.

(2) There is no right of withdrawal under sections 312g and 355 of the German Civil Code (BGB), pursuant to section 312g (2) no. 9 BGB, because this concerns a leisure service provided on a specific date.

(3) By purchasing the Ticket, the Customer expressly acknowledges that the right of withdrawal is excluded.

5. Cancellation, postponement or changes to the programme

(1) If the event is cancelled, the Customer is entitled to a refund of the ticket price alone (excluding system, shipping or advance-sale fees).

(2) If the event is postponed, Tickets remain valid. A refund may be claimed only where attending the replacement date is unreasonable for the Customer.

(3) The Organiser reserves the right to make changes to content or organisation (for example to the line-up, schedule or venue) for good cause, provided these do not substantially alter the overall character of the event.

6. Expiry of validity

Tickets automatically cease to be valid once the event has ended. No refund is possible after the end of the event.

7. Access and admission

(1) Access to the event is permitted only with a valid, undamaged and personalised Ticket together with official photo identification.

(2) The Organiser reserves the right to refuse admission where there is reasonable cause to believe that a person may breach the house rules or safety regulations.

(3) In the event of a breach of the house rules, admission may be refused or the visitor removed from the event premises, without any entitlement to a refund of the ticket price.

8. Liability

(1) The Organiser is liable only for intent and gross negligence.

(2) Statutory liability applies without restriction for injury to life, body or health.

(3) The Organiser accepts no liability for lost, stolen or damaged Tickets.

(4) The Organiser is not liable for force majeure, weather-related cancellations or events beyond its control.

9. Data protection

(1) The Organiser processes the Customer’s personal data exclusively within the framework of applicable data protection law (in particular the GDPR and the German Federal Data Protection Act, BDSG).

(2) Data are processed in order to handle the ticket purchase, to identify the holder on admission, and to meet legal obligations.

(3) Data are passed to third parties only where this is necessary to perform the contract (for example to payment providers or the technical operators of the ticket shop).

(4) The Customer has the right to information, rectification, erasure and restriction of processing of their data pursuant to Article 15 et seq. GDPR.

(5) Further information is available in the Organiser’s privacy policy at www.latin-festival.de/datenschutz.

10. House rules

The Organiser exercises authority over the premises throughout the event site. Instructions given by staff must be followed at all times. Failure to comply may result in refusal of admission or removal from the site, without entitlement to a refund.

11. Final provisions

(1) The law of the Federal Republic of Germany applies exclusively.

(2) The place of jurisdiction for all disputes arising from the contractual relationship is Stuttgart, to the extent permitted by law.

(3) Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
